eBay does have a policy about stealing images and HTML, they are fairly strict about that. But I don't know if us reporting it would mean as much as the YJ seller reporting it. If they are even capable of that. We still don't know if the YJ seller knows English.

I don't think there's a policy on eBay about having the item in your possession. Only because I see pre-orders for sale on eBay all the time. The Nintendo Wii and Sony PS3 being two prime examples from recent history. They might have a policy, but we'd have to read it to learn more to know if it's applicable here.

Now, if the eBay seller was selling the same item without stealing the auction design, that might be acceptable. At that point, he's not stealing someone else's work. Then he'd probably within eBay's guidelines. Doesn't necessarily change my opinion of what he's doing, but still...
ah whoops! Well that would be a problem then... I guess the person already assumes he will win the auction and try and resell it on ebay for a profit? Or perhaps the person really has a cel VERY similar and is not cel inclined to know that different cel numbers are actually very different.. I guess this could be confirmed if someone wanted to email the ebay seller and simply ask what the cel # is and if he could provide an additional scan which would then verfiy either he has it or he doesn't. As far as the wii and PS3 are concerned they actually had to follow VERY strict rules for the preorders. Below I have copied the rules:

EBAY'S RULES FOR PREORDERS:

Only one of each console can be listed per eBay account prior to the launch of the console (PS3 is expected to be available on 11/17/06, Wii on 11/19/06).
The seller must only accept payment through PayPal, and have at least 50 feedback with a 98% or greater positive rating so that they qualify for PayPal Buyer Protection.
The pre-sale item must be listed in the 3, 5, 7 or 10-day formats, and cannot use Buy It Now.
The listing must include a photo of your pre-order receipt in the description.

I cited the game consoles as recent examples, but those specific rules were very strict due to the hype. Those game systems were experiencing lots of fraud and dead beat bidders, which is probably why their rules were amended.

I've won auctions where a statue was pre-ordered through a seller (usually a comic shop), and I think those rules are not nearly as strict. I don't think normal pre-orders have such harsh rules, do they? I haven't won a pre-order auction in about a year, so I don't know first hand. Things may have changed.

If you ask for another picture, I imagine the eBay seller just sending you another picture from the YJ auction (since there's three there). That would probably further prove that he's selling/reselling the same item.

If they cancel the auction afterwards on YJ, I believe that they would get an automatic negative feedback--as in, a machine-produced message and feedback count. But, I believe that those go away after a certain amount of time. In any case, I've always gotten the feeling that canceling auctions after the fact is not nearly as looked down on YJ as on ebay.

People who buy on YJ to resell on Ebay piss me off in general (I hate being outbid on a cel and seeing it show up for twice or even ten times as much somewhere else :x ) so I'll send the YJ seller a little message. :)

I mean, it's one thing if you actually go to Japan and buy from a brick and mortar store, but most cel collectors who are willing to pay $200+ for cels already know about and use YJ (though I don't think all Inuyasha collectors fall completely into this category).

I definitely agree. I -hate- being outbid by a reseller. But if no one bids, then I guess it's ok. I mean, as long as an interested party is not denied access to an item they want, it's probably ok. More than likely, the seller will get nothing for his efforts.
