ah whoops! Well that would be a problem then... I guess the person already assumes he will win the auction and try and resell it on ebay for a profit? Or perhaps the person really has a cel VERY similar and is not cel inclined to know that different cel numbers are actually very different.. I guess this could be confirmed if someone wanted to email the ebay seller and simply ask what the cel # is and if he could provide an additional scan which would then verfiy either he has it or he doesn't. As far as the wii and PS3 are concerned they actually had to follow VERY strict rules for the preorders. eBay does have a policy about stealing images and HTML, they are fairly strict about that. But I don't know if us reporting it would mean as much as the YJ seller reporting it. If they are even capable of that. We still don't know if the YJ seller knows English.
I don't think there's a policy on eBay about having the item in your possession. Only because I see pre-orders for sale on eBay all the time. The Nintendo Wii and Sony PS3 being two prime examples from recent history. They might have a policy, but we'd have to read it to learn more to know if it's applicable here.
Now, if the eBay seller was selling the same item without stealing the auction design, that might be acceptable. At that point, he's not stealing someone else's work. Then he'd probably within eBay's guidelines. Doesn't necessarily change my opinion of what he's doing, but still...
EBAY'S RULES FOR PREORDERS:
Only one of each console can be listed per eBay account prior to the launch of the console (PS3 is expected to be available on 11/17/06, Wii on 11/19/06).
The seller must only accept payment through PayPal, and have at least 50 feedback with a 98% or greater positive rating so that they qualify for PayPal Buyer Protection.
The pre-sale item must be listed in the 3, 5, 7 or 10-day formats, and cannot use Buy It Now.
The listing must include a photo of your pre-order receipt in the description.
