OK, I've been very fair and civil during this, and have not made a single personal attack here. I stated the facts, only the facts, and did not deserve this kind of reaction.

As I was in the process of e-mailing you, I was debating eating the cost and keeping the thing, because I hate to see art totally destroyed, which is exactly what would happen if I did the insurance claim - plus I'd still be out $23. Not once did I state I expected a refund and to keep the cel. Not once did I mention taking steps to reclaim losses. I purposely avoided making outright demands when this started, hoping you would be honorable and willing to provide options.

I also never stated I did not want insurance. You charged me in your original invoice, and I paid. It was that simple. I thought your fees were high, but assumed this would reflect quality service, and did not argue.

Thanks for your post, but that is not the case.

The only postal insurance requirements for documents (and a cel falls under the postal definition of 'documentation') is a rigid cardboard envelope, marked with the appropriate postal warnings of 'fragile', and/or 'do not bend' if it contains sensitive information. Actually, bubble wrap linings aren't even required for this purpose.

And again, that isn't even the issue. As she stated to me in more than one email, it is not that she's afraid the insurance claim won't be honored... she *doesn't want to give up the cel for any reason*. She doesn't want to return it for an insurance claim... her paraphrased wording was 'But I'd have to give up the cel!', and she doesn't want to return the cel to me for a refund either.

She wants to KEEP the cel, and get her money back. This is completely unrealistic.

I am going to step in here and first off say, that if you two
have anymore mud slinging to do, I suggest you do it in
pm's. :?

Secondly, she does not have to return the cel to you if
she makes an insurance claim. The post office may keep
the cel, but in no way is she required to return it to you. :roll:

Finally, your shipping methods apparantly aren't very good,
and to charge someone who buys a $100 cel $23 for shipping
is outrageous. You should have been able to overly protect
that cel for that kind of money.

Now, if you two are indeed emailing each other back and
fourth, I suggest you continue doing so, and keep all of
this off of the board. Otherwise I will lock the thread. :?

I will stop replying to this thread per request. I will keep it off the board and in emails to the buyer and everyone else.

Anyone who wants further proof, questions, etc. of any and all claims on this board, can email me directly. So we can keep it off the boards and respect the admin.

Gonzai: As I stated BEFORE the options:
She can claim the insurance to the post office. I did not state she had to return the cel to me if this option was used.
Or she can return the cel to me, not claiming insurance and I would refund her.
Either way, she can't keep the cel. Either it's by me or the post office.
These are two different options, if you read my previous posts. I DID NOT STATE she had to file insurance then give me the cel.
Or I can weigh in a third option, of refunding some money for damages if she wishes to keep the cel.

That is all.

Xellos, I'd suggest talking to your local post office. From what I remember wolfette saying a loooong time ago, they will only take the cel for a period of time to process the insurance claim. Since it is a one-of-a-kind piece of art, they'll return it to you after the investigation is finished.

But double check just to be sure. :wink:

In any case, I'd think that it would be the seller's responsibility to help you in the insurance claim process, but it seems like she won't, so it might be best to take things into your own hands. :)

Hi,

I just wanted to say I'm sorry for your damaged cel. I once got a cel, with no bag, in a priority mail envelope :flushie what were they thinking?

I do also want to say that I purchased a Devil Hunter Yohko cel from Shelene and it arrived in perfect condition

what-ever the out-come is I hope everyone will be satisfied :ghug:

I've been talking to beta moderators, who seem to agree it's ok to post this. The seller never followed through, and after over a year, it seems safe to say never will. Be careful when dealing with this seller, and don't automatically trust what she says.

I'm sorry to hear that things did not work out for you, xelloss. I do want to add that myself & Yoshito successfully completed a transaction with this seller last year for two Dirty Pair Flash OP cels with no problems whatsoever.

to be fair, ive been charged $24 by paypal for recieving a $500 transaction..dont be too harsh on her.
