If you did it on your credit card through paypal, do a chargeback. You'd probably get the money back within 72 hours.

I think I might just do that. If I don't get the cel or hear from her before next weekend, I will threaten to do a chargeback. It looks like I MOSTLY used the credit card to pay for it, so it might work.

I hope it scares her, or she's not able to interfer somehow.

She won't be able to. When you do a chargeback, you go through your CC company rather than Paypal. Which is why you actually get your money back, and it's also why Paypal will take the money out of her bank account if she still has a working one linked to her PP account. Most CC companies will give you a chargeback really easily. I once got one when someone sent me the wrong DVD and wouldn't send me her address to ship it back. I even told my CC company that I still had the wrong DVD, and was waiting for an address. PP can't fight the chargeback, as they are not the ones who were supposed to ship out the cel and thus have no proof.

Thanks for the info! I have sent her an email threatening to get a refund if I don't get the cel or hear from her by next week. I didn't want to do it, but I'm fed up :l I just really wanted the cel, and I thought if I was all nice about it, she'd be faster. Guess not.

I talked to my dad about it, and he said the other person has to "agree" to the refund? Argh, this is all so confusing. Will have to see what happens, and I'll keep you all posted :)

As klet implied, the only way that the other person can dispute a chargeback is if they have proof that they sent the item. Credit card companies take the internet fraud thing pretty seriously.

By the way, sometimes initiating the chargeback is enough to get your item shipped; the only time I ever did it (and I wasn't nearly as patient as you have been - I think that I waited three weeks), the seller sent my item the same day that he found out about it. As soon as I received it, I called my CC company, they reversed the chargeback, and everyone was moderately happy. I hope that you have similar luck.

You seem quite eager for it.

Update - called card company, and they said they can't do anything unless I can prove the item was never sent. There isn't anything I can do to get my money back through Paypal somehow? I really want my money back :O

How long has it been since you sent the payment? I think pp has a set time period in which you have to start the dispute, and I'm not sure if they even cover off-Ebay transactions. :x

Your credit card company is messing with you. The burden of proof is on the seller, not the buyer. Try calling again, or initiate the charge-back online. Most (if not all) credit cards will have a site you can sign up for with your account, and do online banking. That's how I did the one chargeback I ever had to do--online.

Wow, I never updated on this :?

Found out this particular card can't be "banked online" (or so my dad tells me - I had to borrow money from him as I didn't have all I needed at once at the time).

So, now I'm fuming and furious and still emailing this girl, trying to get her to just TALK to me.

GRRR... still no word! I may have to give up and cry over losing the money. I don't know what else to do at this point.

Sorry, guys, just had to get this out of my system.
