Either this guy is very confused about something or he just is greedy/a scammer.

If he really does expect the $207 along with keeping the cel, I would just ignore him. I don't agree that he should keep any money at all if he got the cel in the end, but I guess that was part of the agreement.

The $207 was sent, but if that really never turns up I think that’s just tough luck enough. He doesn't deserve it anyway.

I hope I read/understood that correctly anyway X(

Again, go to the post office and report her for frasud and say the buyer took off with the insurance money the post office gave her. I would file a mail fraud claim.

Keep all e-mails and records. Paypal cannot take back the money from you if you can prove that you sent the cel and the buyer received it already (and even said it was good shape and everything).

I would tell the buyer to buggar off, block them from bidding, and ask them to never contact you again.
Can I ask you a favor to e-mail me the information from this buyer (or PM me)? I want to keep a record of this person and block them from bidding on my auctions. I don't like this one bit.

:hurt: :hurt: Damn...... I'm speechless at what a tool this guy is. He should have sent the money back to you/Rosemary. He doesn't need the money since he has the cel. I agree it's a total scam and would report him to the IFCC as well as paypal. Put the screws to this ass.

Graymouser has nailed what happened on the head.
I was the one who originally told him that if the cel
arrived, he could keep it and not pay me the money back.
The money I sent him was from a USPS claim, so I am
not out money. Rosemary is the only one out money,
and that is the $207 money order that is lost in the mail.
I emailed her, and she is going to file a claim on it to stop
payment. What really irked me the most about this, was
the fact he did not contact me right away once the cel arrived,
and just said forget about the $207. Or, it would have been
nice to split the $500 claim, though, it really is the Post Office's
money. To take the money, the cel, and then complain cause
he hasn't received the other $207, stating that he just wanted
what was his is what frustrated me the most.

What I'm worried about is the following: shouldn't the USPS eventually come back for their money now that the insured item is no longer lost? I'm sure I read something that if the package turns up, I would have to pay back the insurance claim payment.

It's been a while since the mess I had to deal with concerning lost eBay items though, so I'm not sure what I did with the information I printed out. Plus, the package arrived back at my doorstep before I cashed the check, so I didn't have to find out what exactly would happen.

Man, what a horrible situation to be in! I hate it when shipping goes wrong. And of course it doesn't help that you are dealing with someone who is totally dishonest.

Not only would I tell him that stop payment will be made on the $207, but that you'll also be filing an insurance fraud claim through the post-office and will be using his e-mail confirmation of goods received as evidence to support your claim. You most definitely need to take stand and start the process of exposing this person for the (very bad) scam "artist" he's trying to be.

I would honestly just take this person to court for fraud, and get your cel back. =_= This guy doesn't deserve it at all.

/agreed. I dealt with 3 different people to be exact who lacked ethics as sellers and obviously there are buyers out there who lack it as well.

I think with the economy the way it is right now, people will try to get away with this like this. They had the cel in December they just wanted to try to get as much out of you as possible. I will be VERY surprised if they send the cel back to you. They may have waited this long so you could not do a proper refund on paypal as well. ugh. no bueno.

If you report him to the PO.. will you have to pay them the insurance money back or will he? It would suck if you had to fork over $500 and that buyer is still there.. sitting with your cel laughing his ass off because he got the money and the cel. :hurt:

You should immediately tell the guy to send the money back, then take it back to the post office. If he does not, then you need to inform the post office about the situation, otherwise I will promise if not sooner then later the post office will come calling in the form of a bill stating they want their money back. The government does not let anything like that slide, nor do they care about who is right or wrong. They will look at this and say you knew and you did nothing so sadly you would be the one to have to pony up the dough, it would be best to be safe than sorry.

Damn! I'm so sorry you have to deal with this crap. Some people...

I also think the post office will probably want their money back. The guy definitely shouldn't keep the cel and the money. It's just not right, though it doesn't sound like he cares all that much. :hurt:

I hope it all works out well. Keep us posted. :friends:
