Wow, I am not even sure where to start. Back in September,
I listed a $1500 Opening credits Naraku cel on eBay. I listed
it for a starting price of $700. It never sold. I received an
email from someone who was interested in buing it for the
$700, but wondered if they could make payments. I was fine
with that, and we made the deal. When the final payment
arrived, I promptly shipped out the cel.

About a month later, in October, I received an email from the
buer stating they never received the cel. I immediately filed
a USPS shipping claim on this. The buyer was extremely nice,
and agreed not to file a paypal claim and we could settle it all
amicably. I thought that was super cool. Well needless to say,
the Post Office drug their feet, and it took quite awhile for the
claim to be settled, and them to send me the money, which I
immediately sent him via paypal. By this point it was too late
to refund, so I sent payment and included extra to cover the
fees.

Ok, so here is where I made my mistake. I used click and ship
to send the package, and the maximum amount of insurance
you can purchase with click and ship is $500, which was the
amount I purchased. The buyer paid $707 for the cel including
shipping, even though shipping was close to $12. The refund
was for $500 which was what I sent him, and Rosemary, the
person who I was selling the cel for agreed to pick up the
additional $207, which the buyer agreed to take a money order
so that we would not have to eat any more paypal fees. This
was back on December 12th.

Skip forward to today, and I get the following email from the
buyer:
Good news is: The Cel finally came in! No damage at all and its in excellent condition.

Bad news: I have not received my $207 from you or from Rosemary I think you said that if I remember right.

So the choice is yours, Payment or I keep the cel. Sorry but I think I have been more than patient on this

matter. Let me know what you guys decide ok?

I was thrilled to hear the cel arrived, but was miffed that he
had not received the additional payment. I called Rosemary,
who said she sent it back in December. I emailed the buyer
back letting him know, then I went to USPS Track and Confirm
to see when he received the cel:
Label/Receipt Number: 0503 8555 7491 4167 3494
Status: Delivered

Your item was delivered at 4:19 PM on December 13, 2008 in ANCHORAGE, AK 99516
Now wait a minute. I refunded him $500 on the 12th, he received
the cel on the 13th, and he is emailing me today complaining
cause he never received the $207?? @_@ What am I missing
here? I emailed him back and told him I was fine with him
keeping the cel. I had told him that from the beginning, but was
a tad hurt over the fact he didn't let me know a month ago, even
though he said he would let me know right away if he ever got it.

I emailed him and told him that I was confused by this, and he
emailed back saying he was not trying to play us, which I never
thought he was. This was my response to him:
I am not thinking you are trying to play us. I was just
surprised that you received the cel almost a month ago,
and never let me know about it. I told you in my last email
in December, that if the cel showed up to let me know and
that I would not ask you to pay for it. I was just a little
surprised that you waited so long to tell me. ;_; I hope you
didn't think I would go back on my word. Anyway, Rosemary
is looking into the money order, and I will let you know what
I hear. ^_^
To which he promptly responded:
Whatever it says, I have it and let her track the money order.

Post Office makes mistakes and I am trying to get what is owed me is all.

If I really wanted too, I could of said nothing at all but I didnt.

Anyways, the point is I have it and waiting for payment.

p.s. I am not here to debate and not trying to be mean just want what is mine is all.

Someone want to please explain to me what it is he thinks is
still owed to him?? He has the cel, he has $500. Keep in mind
this is a $1500 OP cel, and at this point he has only paid $207.
He may also be getting that money order as well. >_<

Am I wrong to think that, if he had any decency at all, he would
have emailed the day he received the cel, which was the day
after I refunded the $500, and said, "Hey, I got the cel, forget
about the extra $207.00."? Are people really that greedy?? Am
I the one who is crazy here? Please, tell me your thoughts,
cause I am totally blown away by it all. -_-

There are a lot of people in this world that lack ethics. I've ran into some of them in this hobby, too. What this person is trying to pull seems totally unethical to me.

Why would the $207 still be owed to him? That was only being sent to him as part of a refund because the cel didn't arrive in a timely manner and was originally thought to be lost, right?

However, since the cel arrived, I see no reason for him to get the $207 as well. Isn't that basically like Rosemary paying him to keep the cel at this point... :?

That's my understanding of the situation, at least. :hurt:

Has Rosemary filed a claim for the money order?

I don't think you're going crazy at all either. I seriously don't get why the guy thinks he's owed anything... He got what he ordered, and he doesn't deserve the $207 refund on an item he did receive. The logic just isn't there. If it were me I'd probably have sent the original $500 back for the cel, since I got what I ordered. =\

I'm sorry to hear your having problems/issues with this guy.

That sounds very confusing. My head is still spinning a little.

Maybe he thinks you are asking for the cel back, but he does not want to send it back without a full refund? It could even explain why he waited so long - he was waiting for the rest of the refund before returning the cel. This part of the email really makes it sound like he thought it was an either/or situation.

Once you have made it very clear that he could keep both the cel and the refund, his actions make no sense.

He was easy going enough to not file a paypal claim earlier. Now I think its too late. It doesn't sound like he initially meant to pull anything, otherwise it would have been much easier to do it when covered by paypal. Maybe his financial situation changed and he was depending on the extra refund money. Of course, being in a financial bind doesn't make it OK to try to pull this on you and Rosemary.

I guess the short answer is "I don't know what is going on". I hope it can be worked out. Sorry that you have to deal with this mess with everything else going on right now.

I would ignore him and hope that he doesn't scam anyone else...

Any normal, ethical person would have returned the $500 refund, not demand more money. This person sounds like a complete jerk and a scam artist.

Did you get any money back from the insurance claim at all? Because if you haven't yet, the insurance will not refund you anything saying that he received it.

Now, you need to be VERY VERY strict with this idiot. Tell him that he has to return the $500 to you or the cel (and in turn, you will refund the rest of the $207) or you are going to file a mail fraud because it is considered ILLEGAL to keep the cel and your money. And you will contact Paypal and/or Ebay to claim mail fraud.

Well, the claim was received, and I paid him with the
mail claim. The extra $207 was just the difference.
I had originally told him, that if the cel ever showed
up that I would like for him to email me and let me know,
even though I would not expect him to return the money.
Of course, that was the day before the cel showed up.
If he had emailed me the next day and said hey, the cel
showed up, don't worry about the $207, I would not have
thought a thing. I did tell him he could keep the cel and
not have to pay for it. What bothered me, was that he
waited a month, and then emailed complaining that he
didn't receive his extra $207. :hurt:

I would be asking for the refund money back ASAP. Sounds like a scam to me. The buyer basically gets $500 AND a cel originally for sale @ $1500....Rosemary is getting bent over a table here...

Maybe I am misunderstanding something. I don't want to create a lot of extra controversy but here is how I see it.

Gonzai got the $500 back from the post office. She then sent it to the buyer. The only extra money she has paid so far were the paypal fees to send the money back to him. Her only problem would be if the post office demanded their $500 back from her since the cel was delivered after all. I doubt this is likely to happen, but I admit I don't know what the PO's policy would be in this situation. Of course, the extra headache to Gonzai should count for something, but I wouldn't know what the price tag for that would be.

The person (other than the post office) that is in danger of losing money over this transaction is Rosemary. She sold the cel for $700. Again, the post office (not Rosemary nor Gonzai) refunded $500 to the seller. Rosemary still got to keep the $707 he paid her. Rosemary then refunded $207 of the $707 through the missing money order. Hopefully she insured the full amount of the money order through the post office. Either way, she still has the $500 difference. Even if the cel is worth more, she still sold the cel for $700. Saying that she is out $1500 is not a fair statement. At the most she is out $207 (plus the headache of dealing with it all).

I am not cool about him saying he is owed both the cel and the payment. Previous agreement or not; that doesn't seem right.

As I see it;

If the money order gets to him and he cashes it then he owes Rosemary $207. He has the cel after all. Where it can get complicated is if they disagree on whether the earlier agreement about him keeping both cel and payment still holds.

If the money order never makes it to him then she can get the money back from the post office (assuming its insured). It would then be up to her to decide whether to reissue the refund or not. Again, it would depend on how she feels about the earlier agreement.

The worst case would be if he never gets it and the money order is not insured. She is out $207 that she can not get back from the post office and he is out $207 that he feels was promised to him (even if I feel he is not entitled to it).

Sounds like a crock of crap to me. Well...here is how I see it. If push comes to shove, and he really becomes an ass about things, you can file a claim with Paypal. You sent him money for a service - not a refund. Just a thought - and a way to sort-of protect yourself. I hate the thought of you getting stuck in the middle of this!
