Uber Bitch Stikes Again!

GOD! Just when I thought we were rid of her!
I've been biting my nails for the last couple days. The 30 day statue of limitations
for the old apartment complex to send us a bill for any damages they needed to claim
is midnight tonight / 10am tomorrow morning. (Depending on if you're counting when we
were told we HAD to be finished or when we turned in our keys.) So I've been watching
the mail, because they hadn't sent anything yet. So today's the ninth. Last day for them
to get anything to us, legally.
I checked the mail. Just a bank notice. That's weird tho, it's not time for our statement
yet, plus this is too thin.... THE BITCH TRIED TO GET ANOTHER MONTH'S RENT OUT OF US!
She frikking charged our bank account $593.00 on Dec. 04th. With no notifications. I'm so FUCKING PISSED. So now all the money I was going to buy Christmas presents with, and pay bills has been EATEN by this illegal charge. Not only that, but now we're in a NEGATIVE balance
because I only had about $300 in the bank. And of course, the bank is pissed, so we've got a ton of charges from them for insufficient funds. OH OH I'm HOPPING MAD!

And I can't do a damn thing about it until Monday! And then all I can do is start the process of getting an affidavit against the unauthorized charge. And of course that has to go through the mail, which is understandibly crazy right now, due to the holidays! Meanwhile, the bank's going to be racking up $5.00 a day each day we're overdrawn, and Cam won't be paid until the 15th.


I've spent so much time praying lately, hoping that all this was just God getting us ready for a new life. I never expected it to get worse. I'm so fucking depressed. Why can't I get a break? I try to be
a good person. What am I supposed to do for the kids?! If we have to pay the bank back, we'll only have enough for our bills. It can't be.. It's just CAN'T be that there won't be a Christmas here this year. Miko's just old enough to understand it, Tim's already anticipating it. They spent most of
today watching the Veggie Tales Movie "The toy that SAved Christmas" over and over and over.

I can't do this anymore. This is really testing my faith. If it were just me, heck, I could deal with that.
But my kids. My kids. It's not fair. It's not fucking fair. I know life isn't fair. But this is .. I can't handle this. I want to call Cam, tell him to come home. I need a hug so bad. I need someone to reassure me. Someone to hide the pills. I can't call Cam. Leaving early would give him a demerit, and any
more and he'll lose this job. I don't know, I just don't know. I can't even cry, I'm too stopped up. I'm shaking so hard. can"t let the kids see. It would upset them, might set Tim off into a tantrum.

God, why? Why?

I can't type anymore.


I'm posting this in my journals and blogs. I hope someone will talk me down from this dizzy adrenaline panic I'm in.

OMG, ZAG!!!! I'm so sorry to read about this!!! No wonder you're upset!!!

Put down the pill bottle, or the booze, and if it were me, I'd go RIGHT DOWN TO THE POLICE STATION AND REPORT THE COW FOR THEFT!!

After all, that's what her actions amount do, right? I'd at least try! Go to the police and explain it all and see if they can arrest her, or at least file a report to go on a record somewhere. At the very least you can vent and that will make you feel a bit better.

As for the kids, not having any myself, this is just a "swag" (semi-educated wild-a** guess) but I'd probably contact my relatives and see if they can mange to get the kids one or 2 things that they REALLY want for Santa to bring, and then just buy a few (2 or 3) much smaller things at a discount store or something. Everyone else will just have to understand, as I'm sure that they will.

After all, this is supposed to be a time for family, right? So it seems to me that they could pull together and help you through this. Mind you, you're gonna owe them BIG TIME next year, so then you'll have to make cookies and make the turkey and goodies and everything next year, but by then I'm sure thing will be better.

In the mean time, I'll say a prayer for you and hope that the police can do something.

I don't know what all the legalities associated with that are, but I would automatically notify my bank of a fraudulant, unauthorized charge. Banks can be very strict about that sort of thing. At the very least, I'd go down to talk to them on Monday and see what you can do about the charges--you should not have to pay NSF charges for a fraudulant charge to your bank account, right?

I don't know how serious you are about the pills, Zag hun, but if you really care about your kids, you will stop that kind of thinking right now. Kids may want toys and they may throw tantrums when they don't get what they want, but the absolute worst thing that could happen to them right now (or ever, for that matter) is to lose their mommy. They'll forget about Christmas, but they could never forget about you. What's a pile of toys compared to the woman who loves them?

I'm going home to my parents' on Thursday, and I'm going to talk to my mom about what kind of stuff you can get from the state and feds for Tim, and how to go about doing it. My brother's autistic, and I know that at the very least he gets free perscriptions. It might not seem like much, but it's been a life-saver for my mom. He also gets someone from the state who comes it to work with him a couple times a week. I think it would help.

For right now, hun, hang on! Things will get better, but only if you have faith and trust and don't do anything reckless!!!! You're scaring me. :l

Simply put , while this is a pain right now, once you get to the bank on Monday all should be able to get straightened out.

1. Bring documentation that you have moved out and that her charge against you is illegal and is in truth fraud as well as theft of funds.

2. The bank should refund any overdraft charges , if not ask to speak to a supervisor and do let them know that you plan to then file a complaint with the state Banking commission as well as contact your local congressman after contacting your Lawyer. That normally is enough to get them to waive those charges.

Oh Zag I'm sorry to hear this. I think you should definately take legal action on this woman. At least find out if you can do something about this.

I talked to my mom who deals with problems like this all the time at her work (she's an assistant manager at a credit union)... She said (as JWR said) that if you go into your local branch on Monday, you should be able to clear it all up there by filling out an affidavit form for an unauthorized charge. If they don't have affidavit forms, ask to have it faxed there or something, because they should have a quick way to deal with this kind of thing. Also, she said that if you have to mail something in (which you shouldn't), use priority mail, since it is well worth the $4-5 to get it there fast. Skip the police and dealing with the old landlady, the bank is the quickest way to have your money returned and most likely your fees waived!

I'm sure everything will work well out in the end :^^:

Aww, uber hugs to everybody. Your advise and webbie-hugs really helped.
Cam called, and I blubbered into the phone at him and he jumped right in the car and came home. Said that they were sending people home early anyway because of less business than expected. I got big hugs, a shoulder to sob on, and a long nap. (natural, no pills. :) ) I feel much better after reading all the responses, and feeling like I'm not carrying all this alone.

Also, thank you all for the advise about the kids toys. I'm going to dig into my address book and call up the aunts and uncles we don't see much.

And klet, thanks sweetie. I've got paperwork to finish filling out for MRDD and disability. I'm just waiting on some forms from his school. Thank you so much for in advance if your mom has any other advise!
